United States Policy for the South China Sea

Whereas;

A. The South China Sea beyond the 200 mile Exclusive Economic Zone of each maritime state, is a global commons, open for free passage to all nations and belonging to no nation. And,

B. The United States recognizes Filipino and Vietnamese claims to islands within their EEZ and or as mandated by international law. And,

C. The United States will uphold international law in the South China Sea with equal treatment to all nations. And,

D. The United States will seek cooperative agreements with smaller nations around the South China Sea to aid and assist them in their defense of their territories, their claims to their territories and their EEZs, to provide aid, assistance, navigational assistance and cooperative joint patrols with these nations throughout the South China Sea.

Therefore, to secure the above aims, the United States shall;

1. Establish the South East Asia Mutual InterSea Treaty (SEAMIST) consisting of Vietnam, the Philippines, Brunei, Malaysia, Singapore, Taiwan, Indonesia, Australia, Japan, India and the United States.

1.A. The purpose of SEAMIST will be first 1) mutual defense against aggression, 2) joint patrols within each others territories and through the South China Sea, 3) to aid in any natural disaster or emergency within the territories of the SEAMIST member states or inany location of the South China Sea, 4) to recognize that an attack or act of aggression against any one member is an attack or act of aggression against all members and that each
member state shall come to the aid of the other in any such incident.

2. The United States will provide 365 day, 24 hour presence within the South China Sea.

3. The United States will sail, overfly and navigate within 9 nautical miles of the territory of any member state or of any feature or island within the boundary of the South China Sea to include direct overflights.

3.A. Operations under Section 3 will be without “innocent passage” and will be conducted on a full war footing.

4. The United States will seek cooperation and joint patrols of the South China Sea from NATO members with the recognition that Article 5 of the NATO agreement is in force.

5. The United States will oversee the transfer of administration of certain recently developed regions in the South China Sea to their proper owners.

6. The U.S. Navy and Coast Guard will provide escort upon request to all SEAMIST members resupplying territorial forces, transferring troops or supplies over water, while fishing in territorial or international waters and while conducting resource exploration, development or extraction, or such other matters as members may request.

7. In cooperation with and with agreement by, the Philippines, construct and maintain US military forces establishments on Palawan Island.

8. In cooperation with Vietnam, US forces will visit Vietnamese naval, air and ground force facilities on a more frequent basis.

9. Increase and or establish commercial trade agreements or development and aid packages to SEAMIST members.

10. With agreement with SEAMIST members, US forces will conduct occasional courtesy calls at SEAMIST territories external to their national EEZ.

11. Establish a joint communications and command center to oversee all transits, passages, overflights and operations within the South China Sea and communicate this information to all SEAMIST member forces in the area.

12. Establish a Joint Task Force to shadow any ship, aircraft or force movement of any state which any international court has ruled is without authority or claim in the region and which has displayed bellicose actions and or intent within the region or to any member SEAMIST state or has or is claiming territory within the South China Sea outside of international law.

13. Establish a Joint Submarine Task Force to train SEAMIST member forces in submarine warfare and underwater operations.

14. With or without the cooperation of any other state, the United States shall conduct such operations as may be deemed appropriate and or necessary to maintain the peace and stability of the region, assure the authority and sovereignty of any SEAMIST member state and enforce international law.
